Please read these Terms of Service (ToS) carefully. By engaging Tiny Home Haulers (THH) for services, you agree to be bound by these terms, which constitute a legally binding agreement between you (“the Client”) and Tiny Home Haulers (“the Company”).

1. Acceptance and Agreement

1.1. Binding Agreement: These ToS govern all contracts, agreements, scheduling, and invoicing for all services provided by THH. Payment of any deposit or signed acceptance of a Service Quote constitutes the Client’s full and unconditional acceptance of these ToS.

1.2. Service Definition: “Services” include, but are not limited to, the transportation and delivery of the Client’s prefabricated home or RV (“the Unit”), site preparation, foundation setting, tie-down installation, utility connection, and administrative assistance.

2. Scope of Services and Limitations

2.1. Logistics and Delivery

THH agrees to transport the Unit from the agreed-upon origin to the Client’s designated site. The Client acknowledges that all delivery times are estimates and THH is not liable for delays caused by traffic, weather, mechanical failure, or governmental inspection.

2.2. Site Services and Utilities

THH is responsible for the setup of the Unit as detailed in the Service Quote (e.g., leveling, tie-downs, basic utility hookup).

  • Utility Connection: THH is responsible for connecting the Unit to existing utility demarcation points (e.g., electric pedestal, septic tank inlet, water meter). THH is not responsible for the supply, pressure, or quality of the utility provided by the third-party utility company.

2.3. Administrative Assistance (Permitting and Zoning)

THH offers administrative assistance in securing necessary permits, licenses, and insurance documentation.

  • Limitation: THH does not guarantee the issuance of any permit, variance, or zoning approval. The final legal responsibility for zoning compliance and permit adherence rests solely with the Client. Fees paid to third-party government entities for permit application are non-refundable, regardless of the outcome.

3. Client Responsibilities and Obligations

The Client warrants and agrees to the following:

3.1. Accurate Information: The Unit’s dimensions, weight, and TECV (Total Estimated Cash Value) provided to THH are accurate and verified.

3.2. Site Access and Readiness: The Client guarantees that the designated site is accessible, cleared, and legally ready for the service commencement. This includes, but is not limited to, securing necessary easements, rights-of-way, and ground clearance for THH equipment (12 ft width and 14 ft height minimum).

3.3. Pre-Transport Security: The Client is responsible for securing all internal contents of the Unit, including appliances, furniture, and loose items, to prevent shifting and damage during transit. THH is not liable for damage to unsecured internal contents.

3.4. Financial Obligation: The Client shall ensure all outstanding balances, including the non-refundable insurance premium, are paid in full prior to the commencement of the Delivery Cycle.

4. Pricing, Payment, and Cancellation

4.1. Service Quote: All pricing is provided via a detailed Service Quote, valid for thirty (30) days from the issue date.

4.2. Deposit: A non-refundable scheduling deposit is required to reserve equipment and initiate route planning and administrative work. This deposit is credited toward the total Service Fee.

4.3. Cancellation and Refunds: Client cancellation is subject to the Tiny Home Haulers Refund Policy, which specifies a tiered forfeiture schedule based on the timing of the notice relative to the service date. Non-refundable administrative and permitting fees are always retained.

4.4. Change Orders: Any deviation from the original Service Quote requested by the Client (e.g., change of site address, added services) is subject to a revised quote and potential fees. THH reserves the right to suspend work until the revised payment is secured.

5. Risk, Liability, and Indemnification

5.1. Insurance: The Client is required to pay the mandatory, non-refundable Insurance Premium as detailed in the THH Insurance Policy. This policy provides coverage against damage to the Unit during the Coverage Window, subject to the deductible and exclusions specified therein.

5.2. Company Liability Limit: In no event shall the total liability of THH, its employees, or its contractors for any claim arising from these Services exceed the Total Estimated Cash Value (TECV) of the Unit as declared by the Client and documented in the Bill of Lading.

5.3. Indemnification: The Client agrees to defend, indemnify, and hold harmless THH from and against any and all claims, damages, liabilities, and expenses arising out of or related to:

* Any property damage or personal injury that occurs after THH has completed the service and the Client has signed the Certificate of Completion.

* Violation of any local zoning ordinances, codes, or regulations that were not disclosed or known to THH.

5.4. Force Majeure: THH shall not be liable for any failure or delay in performance due to acts beyond its reasonable control, including but not limited to, acts of God, civil unrest, labor disputes, material shortages, or government action (including denial of permits).

6. Governing Law and Dispute Resolution

6.1. Governing Law: The laws of the State of [State where Tiny Home Haulers is headquartered] shall govern these ToS and any dispute arising hereunder, without reference to its conflict of laws principles.

6.2. Dispute Resolution: Any claim or dispute arising out of or related to these ToS shall first be subject to mandatory, binding arbitration in [City, State where Tiny Home Haulers is headquartered], pursuant to the rules of the American Arbitration Association (AAA). The decision of the arbitrator shall be final and binding.
